Phase 2: capturing before it commences

Nine hazard types — excess cold, excess heat, the three falls profiles, structural collapse, fire and explosions, electrical hazards, and domestic hygiene — are fully capturable on the platform today. Their statutory clock is not yet running.

What it is

Awaab’s Law Phase 2 commences 30 November 2026. As of today it is not yet in force: GOV.UK published its guidance for Phase 2 on 13 July 2026, and the amendment regulations that bring it into force — the Hazards in Social Housing (Prescribed Requirements) (England) Regulations — were laid before Parliament that same day. Laid before Parliament is not the same as made law. The platform will not treat Phase 2 as commenced, for any hazard, until the regulations are confirmed made against the actual published instrument — a deliberate, one-line human decision, never inferred from the calendar date alone.

Every Phase 2 hazard is built to full capture depth now, on purpose: so your organisation can raise real jobs, capture real evidence and build a baseline ahead of the duty biting, rather than starting from nothing on day one.

How to do it

1. Raise and run a survey for any of the nine Phase 2 hazards exactly as you would for damp & mould — the wizard, the AI assistance and the report are all fully built for each.
2. Where a Phase 2 case is judged an emergency on Hazard Triage, it is already in scope today under Phase 1 — every emergency hazard is, regardless of its own phase. A non-emergency Phase 2 case instead shows a plain note that its statutory clock is pending, rather than a live deadline.
3. Keep triaging and evidencing these cases as normal — nothing about how you capture a Phase 2 hazard changes once Phase 2 actually commences; only whether a live deadline is stamped onto it does.

How it integrates

The same registry entry that activates a Phase 2 hazard’s wizard sections and report template also carries its descriptive statutory-phase metadata — but the work order’s actual statutory block is stamped only once the platform’s own commencement gate confirms the phase has both arrived and been confirmed against a made instrument. Until then, every display surface — the New survey form, the report, the job drawer — shows the same honest “pending Phase 2 commencement” explanation rather than a fabricated date or silence. The moment Phase 2 is confirmed, every case already captured for one of these nine hazards has its full evidence trail in place — nothing needs to be recaptured retroactively.

Common problems

• A Phase 2 hazard shows no due date even though it feels urgent. If it’s genuinely an emergency, record that on Hazard Triage — an emergency case is in scope today regardless of Phase 2. If it isn’t, the absence of a date is correct: the statutory clock genuinely hasn’t started for a non-emergency Phase 2 case yet.
• I’ve heard Phase 2 “starts” on 30 November 2026 and want to know why nothing changed that day. The clock only activates once the regulations are confirmed made against the published instrument, not automatically on the calendar date — if that hasn’t happened yet, the honest pending explanation continues to show.
• Should I wait to start using these hazard types? No — capturing now is the point. Waiting only means starting your evidence baseline later than you needed to.
